Judges Erastus Githinji and, Jamilla Mohammed and Hannah Okwengu all ruled that the verdict from the High court was appropriate.
The court of appeal dismissed the case against the gubernatorial aspirant on the basis that it lacks merit.
The new development is a huge blow to incumbent Machakos Governor Dr. Alfred Mutua, who is defending his post in the forthcoming general elections.
Ndeti had been taken to court on the grounds that she belonged to two political parties at the time of nominations. The lawmaker was being investigated for being a member of Wiper and Chama Cha Uzalendo (CCU) where she used to serve as the party leader.
On her part, Ndeti insisted that she resigned from the party before crossing over to join Wiper Party under the leadership of former vice president Stephen Kalonzo Musyoka, now NASA Deputy President.
Ndeti’s win in the nomination case is a big boost to her campaigns. The aspirant has encountered several issues including differing with Machakos Senator Johnson Muthama, who termed her a thief following her win over Deputy Governor Bernard Kiala.
