The Machakos High Court on Thursday directed Maendeleo Chap Chap Movement Leader Alfred Mutua to release funds the salaries and expenses of the county within a period of 14 days.
While ruling in a case against Mutua and the county government Lady Justice Pauline ordered to second term governor and other officials to ensure that Ksh.79,254,659 are remitted for the said purposes. Ksh.16, 006,613 will be used for development budget while Ksh.63,248,046 of the monies for recurrent expenditure.
The court also dismissed the reasons the county boss and his team had presented in regard to the failure to remit the monies. In the case filed December 4, the complainants asked the court to direct Mutua and the county government to remit the cash to allow for smooth operations.
“Taking into account the principle of public finance management, the petitioner has been able to show compliance with the law as regards the release of the money and it is proper for a mandatory injunction to be issued,” she ruled, as quoted by Citizen TV.
Until the ruling was made, monies accruing to the MCAs and workers of the county had not been remitted. Mutua had refused to approve the proposed budget arguing that the MCAs push was meant to misuse what belongs to the common mwananchi.
