Eric Mutua, a former Law Society of Kenya Chairman, has moved to court to bar Former vice President Stephen Kalonzo Musyoka-led party from issuing nomination certificate to his rival Gideon Mutemi Mulyungi for the Mwingi Central parliamentary citing election malpractices.
The lawmaker has obtained an order restraining the party from presenting a candidate to the independent Boundaries and electoral Commission (IEBC) until the matter is resolved, Nation reports.
Through his lawyer Nzamba Kitonga, the parliamentary hopeful lamented that the exercise was marred by all sorts of malpractices aimed at denying him the victory he deserved as the next general election date draws closer.
The Political Parties Dispute Tribunal under the leadership of Mr Kyalo Mbobu has issued a directive for the stay of execution of the party’s National Appeals Tribunal’s decision that had earlier on dismissed the petition filed by the aspirant in regard to the matter.
The court has, however, refused to cancel the outcome of the election as requested by Mutua.
Both the hopefuls will be dealt a major blow in the event that the matter is not resolved before May 4, which has been declared as the dateline for candidates who want to contest independently because of different reasons.
