Machakos Governor Dr. Alfred Mutua has insisted that he has no case to answer in relation to the August General election. According to The Star, the county boss wants a petition filed by former Kathaini MP Wavinya Ndeti of Wiper dropped on the grounds that it lacks merit.
The Maendeleo Chap Chap Movement leader argues that the failure to enjoin his Deputy Governor Francis Maliti as a respondent makes the case faulty and not worth being listened to by any court in the country. In a sworn affidavit, the governor argued that he and his deputy are inseparable.
“This is incurably and fatally defective since Article 180( 5 ) of the Constitution mandates a county governor to nominate a qualified person to be elected as a deputy governor,” he said.
Ndeti, who filed a 10,000-page petition, said that the exercise was marred by all sorts of malpractices including the nonexistent polling stations.
She called for another election that will reflect the will of the people of Machakos.
Mutua has, however, insisted that she has no evidence to prove her claims.
“The receipt of this petition was not acknowledged by the registrar, therefore breaching the mandatory provisions of the law and, as such, the same is incurably defective and must be struck out.”
