The members of the family of the late Makueni Senator Mutula Kilonzo have agreed to solve their property dispute out of the court room.
The family has been embroiled in wrangles for long despite the late Senator having written a will on January 14, 1987.
According to a section of the will, Mutula declared that Pricilla Felista Mutete was not entitled to receive anything from his property when he dies.
“I declare that my marriage to her was finally dissolved by the High Court of Kenya at Nairobi in Divorce case No. 1 of 1980 by way of decree Absolute issued on 22/8/85. A certified copy is to be found in my office file No. 447A/80,” reads the will, as quoted by Citizen.
In the will, Mutula made it clear that Mrs Cyrose Nduku Musau was his sole lawful wife.
He also appointed her (Mrs Cyrose Nduku Musau) and his father Kilonzo Musembi to act as the sole executors of the will upon his death.
Mutula further wrote that the executors of the will should sell his law practice, fixtures as well as fittings and use the proceeds to invest in his estate.
Makueni Senator Mutula Kilonzo Jr, Rose Wanza, Kethi Kilonzo and Michael Musembi have, however, objected their Step Mother, Cyrose Nduku from dividing the property individually.
