Stephen Ngila who allegedly battered his wife Jackline Mwende was on Wednesday arraigned in a Machakos court where he denied the charges of an attempted murder.

The Resident Magistrate, Kipkirui Kibellion heard that the accused is a dangerous character and may cause more harm to the accused.

The prosecution applied to have the accused denied bond as he is likely to interfere with witnesses and the security of the complainant may be at risk.

Ngila, 34, was accused of attempting to kill Mwende on July 18 at Ilinge Village in Masii location by chopping off her hands using a panga and thereby causing severe injuries in her limbs and skull.

“From the probation report presented, there seems to be a community hostility over the action and if released, Ngila may be injured or revenge to the complainant. I therefore deny him bond ," said Kipkirui in his ruling.

Defence lawyer Moses Kamolo told journalists outside court that they would appeal the decision as Ngila has the constitutional duty to be released on bond.

“The mere fact that my client lives in the same locality with the prosecution witnesses does not amount to those compelling reasons. We will appeal for that ruling since he is entitled to reasonable bond as per the constitution,” said Kamolo.

The case will be mentioned on September 20.

Mwende is receiving treatment at Kikuyu hospital in Nairobi where she will be given artificial limbs.
