Raila Odinga’s lead counsel James Orengo insists that electoral body IEBC should avail original form 34A and 34B adding that the proceedings will be severely affected without them.
Opposition team is embroiled in another legal battle with IEBC and Jubilee party over alleged fraudulent elections that were held in August 8.
During the pretrial conference on the presidential elections on Saturday, the Siaya senator demanded that the opposition be granted permission to scrutinize the forms and respective servers.
“We have a right to demand access to information and without it; our case will be severely affected. Forms 34A and 34B should be availed for scrutiny.
“Most of these forms are forgeries and we want the original ones to be submitted. IEBC and Jubilee should not be scared if at all they won fairly,” he added.
President Uhuru Kenyatta’s team had opposed the application adding that it would change the basis of the petition hence subjecting them to prejudice.
Paul Muite who was appearing for IEBC said the commission was ready to submit the forms but dismissed the idea of accessing IEBC servers.
