Wavinya Ndeti's lawyer in the petition which she is challenging Governor Alfred Mutua's win has moved to court seeking protection.The aggrieved lawyer moved to court after police stormed his Kileleshwa home.

Ham Lagat alleges that the officers threatened his family and that they are pursuing him for commissioning affidavits and giving evidence on the petition pending at the Machakos court.

The lawyer told the court that he was instructed by Ndeti, on September 5, 2017, to commission the affidavit.Lagat says he acted as instructed and that the affidavits were prepared in the presence of the deponents.

The court heard that the petition was later served upon the governor, who later applied to have it struck out on grounds that the petitioner did not swear the affidavit.

However, the election court declined Mutua's application and ordered that the proceedings go on.

Justice Aggrey Muchelule, the trial judge, ordered Lagat's apprentice to shed light on the disputed signature on the affidavits.

The court was satisfied that indeed the lawyer was the one who commissioned the said affidavits.

Lagat alleges that shortly after he appeared in court on December 11, the county criminal investigations officer visited his residence in the company of Flying Squad officers.He holds that it was there that they threatened his family to the effect that they will face dire consequences. 

The matter will be mentioned on January 24 for further directions.
