Five Nairobi county employees caught with Sh7 million stashed in their office have now moved to court to bar DPP Keriako Tobiko from prosecuting them.
Through their lawyer John Khaminwa, the five said they are raising serious constitutional issues and that should their petitions not be halted, they are bound to suffer serious prejudice.
Luke Gatimu, Maurice Ochieng, Nixon Awuor, Shaban Asman and Bedan Wambui were reportedly found in possession of Sh7,803,876 at their City Hall cash office.
According to the governor, the money was supposed to have been deposited at the bank the previous day.
"Our application seeks to enforce our fundamental rights and stay any further investigations by the against us with regards to the events of August 23, 2017," said Awuor in an affidavit.
They said that should the orders sought against the DPP not be issued, they will suffer a great loss and damage since their constitutional rights will be infringed.
