A Nakuru court on Wednesday heard that four parcels of land are legally owned by Assumption Sister of Nairobi after being allocated and approved by the Ministry of land.

The four parcels located at Elementaita, Langata, Sagana and Kirinyaga each 10 acres and whose ownership has been is disputed between the nuns and Rev William Charles Fryda have title deeds bearing the Assumption Sisters of Nairobi (ASN)

The lands host Saint Mary’s Mission Hospital, Regina Pacis University College and St Mary’s Education Center established in 1998 together with the staff residential areas.

The plaintiff, Fryda who purports to be the sole owner of the disputed lands is said to be the former senior doctor of the hospital and the Father of Maryknoll Fathers and Brothers. He was also a missioner at the hospital but was relieved his duties after allegations of pocketing money meant to run the facilities.

The ASN established the facilities as a mission to help the poor and the needy members of the society, and were approved by the Registrar of Companies in July 16 1999 to offer non-profit making services. The court heard that the finances are from well-wishers and donors which Fryda was part and parcel.

High court Judge Munyao Sila heard that former lands Minister James Orengo issued the title deed of the Langata land on March 25 2010 which today holds the university and staff residential areas.

The plaintiff started claiming the ownership of the lands after he was relieved duties of doctor at St Mary’s Mission Hospital, Gilgil. He alleges that he had given the documents to the ASN which Marie Theresa Gachambi challenged.

Gachambi told the court that Fryda had instructed his lawyer, Macharia Njeru to ensure the lands are registered as ASP and had also hosted various donors and well-wishers.

The four title deeds issued on different dates were presented before court which and bore the name Assumption Sisters of Nairobi, prompting Gachambi to challenge the plaintiff to produce his ownership documents.

The case hearing continues today where more witnesses for the complainants will be done presented before court.
