The troubled supermarket chain, Nakumatt, has moved back to the court in a bid to regain its space at the Junction Mall.
Last week, the court had ordered owners of Junction to evict Nakumatt from the premises.
In a certificate of urgency filed on Thursday, Nakumatt is seeking suspension of the directive.
Nakumatt had occupied the space for the past 12 years.
Nakumatt claims that its business will be further crippled if the decision to have them permanently evicted is implemented yet there are ongoing negotiations with banks, creditors, existing lenders and investors to recapitalise the retailer.
Nakumatt says that it’s over 3,000 employees in Kenya alone are at risk of being rendered jobless and that over 30,000 livelihoods would be affected.
“All efforts to preserve the company and thereby enable it meet all its outstanding obligations stand the risk of being jeopardised leading to the total collapse of Nakumatt’s business,” Nakumatt says.
