Nakumatt supermarket Mombasa branch has opposed eviction from City Mall.

This is after the landlord filed a case seeking to evict the supermarket over rent arrears that stood at Sh27.8 million as of November, 2017.

According to Nakumatt, the mall is strategic for business and case before the court should be dropped.

On Monday, Nakumatt through lawyer Lawrence Ng’ang’a told justice Charles Yano the case before the environment and land court should be struck out because the court does not possess powers to handle the case.

“The court doesn’t have jurisdiction to hear the matter,” said the lawyer.

The landlord filed the case for the court to order the retailer vacate the premises for failing to pay rent and service charges.
