A Nakuru Bishop has been accused of defiling a 16-year-old girl.
Bishop Daniel Lubanga of Christ Chapel Church based in Kaptembwa, Nakuru is accused of defiling the minor on diverse dates in 2009 and on January 27, 2011 when the case was first reported.
However his lawyer, Elijah Maragia told a Nakuru court on Thursday that the prosecution did not have sufficient evidence against the accused and the case was instigated by a group of people aiming to tarnish his name.
He added that the prosecution had failed to prove the age of the complainant as no document had been produced in court which is core for a defilement charge to stand.
Maragia said the medical report given by the doctor in the P3 form could not be relied on to warrant a case as it did not show tests had been done on the complainant.
He stated that the complainant was pushed into pressing charges against his client by members of a splinter group of his church to malign his reputation.
The lawyer called on the court to acquit the suspect saying that other two witnesses gave testimonies that contradicted on where the alleged act was committed and thus could not be relied.
The prosecution objected to the request citing that an immunization card produced during the hearing confirmed that the complainant was aged 16 at the time the alleged offense was committed.
The prosecution added that the accused person was positively identified by the victim and also that PMC and P3 forms produced in court confirmed that an act of penetration actually took place.
Nakuru Senior Resident Magistrate Judicaster Nthuku set the ruling for August 24.
