A court in Nakuru on Thursday declined to compel the Teachers Service Commission to reinstate a teacher who was suspended on disciplinary grounds.

The teacher is said to have had a love affair with his student, which is against the teachers’ code of conduct.

Judge Steven Radido, who heard the case, said TSC acted in its mandate after it suspended and later transferred the teacher to another school. 

The teacher, Hezron Silunya, was suspended and later transferred from Moi Girls’ Eldoret, after the said incident.

“The court is satisfied that the process undertaken by the TSC was in compliance with the law. Silunya’s rights were not violated,” he said as quoted by a local daily.

In the interdiction letter that Silunya received, one of the reasons for his suspension was the said love affair with his student.

“On several occasions during the year 2013, you enticed her by buying her foodstuffs and gifts and on October 18, you had bought her a birthday cake and chips, leading to her sneaking into your house on November 10 at around midnight while you were a teacher at Moi Girls’ High School-Eldoret,” read the letter.

The teacher denied the allegation, but the disciplinary committee found him guilty and suspended for four months, which was without pay.
