The high court sitting in Nakuru will today deliver a ruling in a case where a legislator wants to be enjoined in taxation proceedings.
Justice Janet Mulwa is expected to issue the ruling of an application by Rangwe MP George Oner Ogalo who wants to be enjoined as an interested party in the suit where Kwengu and Company advocates is seeking a client representation fee taxed at Sh216 million from two companies it says it represented in 2011.
The law firm has accused Anglo Leasing and Finance Ltd and the Apex Finance International Ltd of failing to pay the representation fees despite an earlier order by the high court to do so.
The lawmaker through his lawyer, Kenyatta Odiwuor, told Lady Justice Janet Mulwa that the MP was not party to the proceedings of the companies but the law firm lists him as one of the people from whom it received instructions to represent the companies.
Mr Kenyatta further argued that the the MP had become a necessary party to this suit because the orders issued in the proceedings are being enforced against him and urged the court to allow the MP to be enjoined in the matter.
The law firm, however, through lawyer Steve Biko told the court that the legislator is not named in the certificate of cost and urged the court to dismiss his application to be included in the case.
Mr Biko maintained that Mr Oner is an agent of Anglo Leasing and Finance Ltd and the Apex Finance International Ltd and was seeking to be party to the suit to act on their behalf.
He urged the court to dismiss the MP’s application saying it was ridiculous and laughable.
The law firm wants the two companies compelled by the court to pay the advocate representation fees as earlier ordered by the court.
The companies have also disputed the payment of the fees.
