Nakuru high court has redirected parties involved in a legal tussle over appointments to office to be settled outside the courtroom deeming the case ‘too embarrassing’.
The judge presiding over the case, Lady Justice Abigail Mshiila said there was no need for the government to wash its dirty linen in public.
The core of the dispute came about when a Mr Shadrack Koskey, a farmer sued the Governor for allegedly failing to balance his top ministerial and PS appointees instead favoring Kikuyus over Kalenjins.
Koskey, the defendant, argued that even the Kalenjons chosen were majorly from Kuresoi South, blatantly ignoring 10 of the other sub counties.
Mr Koskey who was represented by lawyer David Mong’eri claimed that he had provided the necessary papers to prove that there was foul play in place. Governor Mbugua, who was represented by Law Professor Tom Ojienda failed to give comment on the incident.
Mr Ojienda filed his defense but was advised to engage in ADR (alternative dispute resolution by Judge Mshiila
