The Nakuru district lands registrar Suzanne Nabulindo has turned down a directive to stop subdivision of land in units of less than five acres.

The directive had been issued by the county lands executive Racheal Maina.

Responding to a letter from Maina dated April 17 2014, the registrar noted that the move will usurp the powers of parliament and Lands cabinet secretary Charity Ngilu.

Nabulindo observed that the constitution in article 68 (c) 1 clearly states that “Parliament shall enact legislation to prescribe minimum and maximum land holding acreages in respect of private land.”

In the letter, Nabulindo informs the county executive that the move is against the law.

In her directing letter, Maina had indicated that subdivision of land in smaller units was affecting the agricultural productivity of the area, making the county food insecure.

She wanted such subdivision halted until a county spatial development plan is developed in order to guide land use in the county.

The county assembly has also objected to the directive with majority leader Samuel Waithuki terming the directive as primitive.
