Nakuru County Assembly Speaker Susan Kihika, Leader of Majority Samuel Waithuki together with his Deputy Paul Chebor, now wants the high court to drop a case against them that was filed by former majority leader George Mwaura.
Through their lawyer Tom Ojienda, the three on Wednesday told Judge Abigail Mshila that the High Court lacks jurisdiction to deal with such a case.
"This is an internal party issue that should mainly be arbitrated by the Political Parties Dispute Tribunal. The decision to remove George Mwaura as the majority leader and to replace him with Samuel Waithuki was made by the Jubilee MCAs in the assembly," Ojienda told the court.
Ojienda further went ahead and told the court that the dispute was between George Mwaura and the Jubilee group in the assembly.
"My three clients should not be involved in this case and I therefore urge the court to refer this case to the Political Parties Dispute Tribunal which is mandated to deal with such cases," said Ojienda.
The court will deliver its ruling on the 27th of November.
