Opposition NASA has filed a case against the Independent Electoral and Boundaries Commission (IEBC) over the appointment and transfer of returning officers at constituency and county levels.
In the suit filed on Thursday, the Opposition outfit argues that IEBC acted unlawfully as it made the decision without consulting them.
Through lawyer Evans Otieno, they complained that there would never be fair elections on August 8 if IEBC is allowed to unilaterally choose where the officers go.
"It is in the interest of justice that this application is heard expeditiously to allow the applicant and the people of Kenya have an electoral process that is overseen by independent, credible personnel who have the confidence of all players in the process," read the court papers filed Thursday.
Last week, the commission reshuffled returning officers and scrapped the position of regional coordinator but instead appointed 47 county managers.
In these changes, all the official 290 constituencies received new returning officers.IEBC's 17 regional coordinators were retained as election managers.
