The opposition is now piling pressure on the Director of Public Prosecutions Keriako Tobiko to prosecute those responsible for omissions that led to the August elections being nullified.
Speaking after the Supreme Court delivered its full judgment on Wednesday, NASA MPs led by Opiyo Wandayi (Ugunja), Junet Mohamed (Suna East), Ben momanyi (Borabu) were full of praise for the court, saying it was the only fair decision.
Lawyers Aggrey Mwamu and Nelson Havi joined the talk, saying it was time those who were involved in any way in tampering with the election and transmission of results face the law.
“The judges confirmed that IEBC went around the decision of the Court of Appeal on Maina Kiasi’s petition. The failure by the commission to transmit the dual results is in itself a breach of court,” said Mr. Havi as quoted by the Standard.
According to Mwamu, it was clear before the court that failure on the electoral commission’s part led to illegalities, which largely affected the final results.
“Billions of shillings were spent and Kenyans will still fund the repeat election. Clearly, somebody must take full responsibility for the mess we are in. somebody in the commission must be held accountable,” he added.
The country is set for a repeat election on 17 October, after the court nullified President Kenyatta’s win, citing illegalities and irregularities.
