The National Super Alliance has sued IEBC for appointing constituency and county returning officers without consulting key stakeholders.
The matter was filed on Thursday under a certificate of urgency.
NASA argues that IEBC's move was an affront to principles of the electoral system.
NASA claims that the Wafula Chebukati led commission acted unlawfully by not allowing parties to make representations on appointments as required by law.
NASA further claims the process was secretive and driven by ulterior political considerations.
“The process leading to the unlawful decision is unfair and violates the basic tenets of the rule of law as IEBC did not adhere to the principals of good governance."
The Opposition wants the April 27 decision suspended pending determination of the case on grounds that it undermines free elections.
