Sifuna said Miguna's arrest, detention and subsequent deportation was the highest disregard of the law by the Jubilee administration.

He addressed the press at the Millimani Law Courts in Nairobi on Wednesday.

Sifuna who is among Miguna's lawyers said they will file legal proceedings against the state for infringing on the rights of 'innocent' politicians allied to NASA leader Raila Odinga.

The city based lawyer who unsuccessfully contested for the Nairobi senatorial seat in last polls said they will not keep quite as the Jubilee administration allegedly exercises tyranny of leadership.

"We are going to file legal action against the Jubilee administration especially the Inspector General of Police, Interior CS, CID director and that of Immigration for unlawfully deporting Miguna and 'aimlessly' arresting some NASA politicians.

Sifuna said the country was being turned into a 'Banana' republic arguing that bad precedent was being set for the future generation.

"We cannot and will not allow the government to infringe on the rights of Kenyans which are enshrined and protected in the constitution," Sifuna said.

He said the arrests and detention of NASA politicians spell doom ahead.

 Sifuna urged the clergy, civil rights groups among other stakeholders to come up and condemn the government's alleged tyranny.

He said the silence by the clergy and civil rights groups during the arrests, detention and shut down of Citizen, KTN and NTV stations was worrying.

The government deported Miguna to Canada on Tuesday night.

Miguna was booked in a KLM plane to Amsterdam hours after he had been arraigned in a Kajiado Court to plead on charges relating to NASA leader Raila Odinga's inauguration on January 30.

Miguna did not take plea to the charges, he instead asked the court to have him arraigned before Judge Luka Kimaru at the Milimani High Court in Nairobi.

He was arrested at his Runda home in Nairobi on Friday and had been in police custody before his deportation.

Miguna's deportation has elicited sharp criticism with NASA politicians warning the government against the rule of tyranny.

On Wednesday, Judge Luka Kimaru ordered the Inspector General of Police and CID director to explain the circumstances under which Miguna was handed to the immigration department when he was to be produced in court.

The court also wants the immigration director to explain why Miguna was deported.

The government claims Miguna's deportation was on grounds that he had earlier denounced his Kenyan citizenship when he acquired the Canadian citizenship.

Miguna has however refuted the claim stating he will not give up and will return to Kenya.
