Supreme Court President David Maraga will once again be tasked to decide the fate of the People’s assembly.
This is after the case by the government to stop the People’s assembly was referred to him by Justice John Mativo.
According to Justice Mativo, the case challenging the formation of people’s assemblies can only be decided by at least three judges, hence the referral to the Supreme Court.
The case was filed by the Attorney General, who said the formation of the assemblies was against some parts of the constitution, which is supreme over all other laws and legislation.
“The dispute revolves around the sovereignty of the country which has never been determined by any court. Although the dispute looks simple it involves some deep and complex issues which require a bench on an uneven number to determine,” he ruled.
The judge added that there are some other key interpretations needed the bench to be discussed.
He further gave the NASA coalition three weeks to respond to the 14 counties that had filed the motion of creating people’s assemblies.
