The National Super Alliance (Nasa) has indicated it will respect the ruling by the Appellate Court, that overturned a High Court ruling, that saw, the alliance win the case on presidential ballot papers printing.

A five judge bench ruled on Thursday, that Al Ghurair firm should go ahead with the tendering process, contrary to what Nasa wanted.

According to judges, Alnashir Visram, Erastus Githinji, Roselyn Nambuye, Prof Otieno Odek and Jamila Mohammed, the High Court erred in granting the blocking orders on the grounds of failure to involve public participation.

They said public participation was not a requirement in direct procurement, which IEBC used, to award the contract to Al Ghurair, and faulted the High Court for allegedly failing to recognise there was insufficient time to award the tender to another firm, since elections date is first approaching.

In a quick rejoinder, Nasa presidential candidate Raila Odinga's senior advisor Salim Lone said Nasa would continue monitoring the operations of the Independent Electoral and Boundaries Commission (IEBC) to ensure a free and fair election.

Nasa co-principal Musalia Mudavadi, while speaking in Kakamega County, also raised his voice on the same, saying they will respect the Court of Appeal's decision.

"Despite the unfavourable ruling, Nasa we have no issue. But we will continue monitoring everything that IEBC does. We are ready for the August 8th elections and we want it to be free and fair," said Mudavadi, the ANC party leader.
