On Thursday, National Super Alliance (Nasa) went to court to prevent the current government from stationing the military during the August elections.
Justice George Odunga verified a case submitted by the opposition party alleging that the government has plans to use the military in areas that have been labelled as hotspots.
NASA cited Article 241 (3)(c) which states that the Kenya Defense Forces can be stationed in regions of the country to reinstate peace only after consent from the National Assembly.
The NASA party has shared concerns that deploying the military may affect voters as well as the way they vote in the election.
