In the sittings held at the continental house in Nairobi Tuesday, the petitioner, Barasa Kundu Nyukuri told the committee that he had resolved to file a petition at the national assembly given its constitutional mandate.

Barasa told the committee chaired by Samuel Chepkonga that IEBC is grossly incompetent and cannot be entrusted to hold a free and fair election in 2017.

Chepkonga said the committee will also summon commissioners for a hearing on the petitioner's presentation.

The legal affairs committee has 14 days within which to submit a report to the house as required under standing order 230.

Once the committee tables its report, the house will have 10 days to decide whether or not the petition contains valid grounds for removal of the commissioners.
