The Employment and Labour Relations court has allowed a director at a Nakuru water company to appeal against the taxation of his Sh 14 million award.
Justice Stephen Radido on Wednesday allowed an application by Nakuru Water Services and Sanitation Company (Nawassco) director Geoffrey Asanyo seeking to reverse a high court judgment that reduced his award to less than Sh 1 million.
Asanyo, who represents the business community on the board is demanding the amount from the water firm which is partly owned by Nakuru County government after he won a constitutional petition in court leading to his reinstatement as a board director at the company.
He had been dismissed from office alongside six other directors.
In June last year, his lawyer, Kipkoech Ng’etich filed a bill of cost certificate worth Sh 33 million before the deputy registrar reviewed the amount and reduced it to Sh 14 million by taxing off over Sh 19 million.
The Sh14 million was also disputed and the court made a ruling on January 23, 2015 which saw the amount further reviewed and reduced to less than Sh 1 million.
Asanyo was not happy with the court’s decision and wants to appeal against the decision. He argued that the judge erred in law in setting aside the taxing officer’s decision and figures.
The company and its director are now headed for yet another bruising court battle even before the firm heals from previous supremacy battles that nearly paralysed its operations.
