Chief Justice David Maraga has certified as urgent a petition seeking to stop the fresh presidential election slated for Thursday, October 26.
Three voters had moved to the Supreme Court seeking to stop the elections.
Khalef Khalifa, Samuel Mohochi and Gacheke Gachuhi claim that the Independent Electoral and Boundaries Commission is divided and cannot guarantee a fair and credible poll.
Maraga has directed that the petition be heard on Wednesday at 10am, despite it being a public holiday.
The three in their suit argue that IEBC commissioners are serving partisan interests and Chairman Wafula Chebukati has publicly admitted that he cannot guarantee credible election.
The voters, in their petition, argue that IEBC is not well prepared to hold the elections as the constitution dictates.
They also want the CJ Maraga led court to explain what Raila Odinga's withdrawal from the presidential race means.
