The Director of Public Prosecutions Keriako Tobiko has directed that David Ndii is released on police bond.
Tobiko has also directed that once investigations into Ndii are complete, the file is forwarded to him for further direction.
Ndii was taken into custody by police on Sunday, while on vacation with his family in Diani, before being transferred to the Directorate of Criminal Investigation headquarters on Kiambu Road.
NASA fraternity led by leader Raila Odinga has condemned the arrest together with Ndii's wife Mwende Gatabaki.
“This is not transparent, my husband is not a criminal. I asked these people (the police) what crime has he committed? (And) they couldn’t tell me.” Mwende told the press on Monday.
Ndii has defended his statements on secession as philosophical and not subversive with his family and the Opposition viewing his arrest as
reminiscent of retired President Daniel Arap Moi’s era when the state machinery was manipulated in a clampdown on dissenters.
The directive by Tobiko has just been accepted a few minutes ago and Ndii has been released on a police bond. David Ndii has been released on a Sh10,000 police bond.
