Disgruntled primary and high school teachers who move to court after TSC transferred them to new schools for the year beginning 2018 have faced a major setback after the Kisumu High Court declined to hear their case.
On Friday Justice David Majanja directed that the case seeking to block the massive transfers of high school principals be moved to the Employment and Labour Relations Court for disposal.
In his December 29 order, Majanja pointed out that his court lacks the jurisdiction to determine the matter involving employer and employee.
"The High Court lacks jurisdiction to entertain the case by virtue of Article 169 (2) of the Constitution as read with Section 12 of the Employment and Labour Relations Court Act," said Justice Majanja.
"The matter is hereby transferred to the (labor) court for disposal,' he added.
The teachers have sued TSC and education Cabinet Secretary Fred Matiang'i.
