Walter Nyambati has on Monday expressed his confidence in his new appeal case challenging a court ruling earlier made on his case seeking to invalidate John Nyagarama's August 8 victory.
This will be Walter Nyambati's second attempt to overturn Nyagarama's victory after his earlier petition filed in Nyamira High Court was quashed by judge James Makau on February 27.
"This is an appeal that will succeed. It's a total of 81 records of appeal rich in evidence. We are going to demonstrate that the judge in Nyamira was very unfair," said Mr. Nyambati.
The case was dismissed by the Nyamira High Court judge on grounds of lack of enough evidence to invalidate the win of the current Nyamira governor Mr. Nyagarama.
In his judgment, the judge ruled that the Mr. Walter failed to prove his allegations.
This has seen a new twist in the case filed at the Kisumu Court of Appeal on Monday.
Mr. Walter, in his appeal case, claims that Judge James Makau did not consider the evidence brought before him by his team.
"There were many illegalities which the judge overlooked. That is why we have come here to seek Justice," Mr. Nyambati, a Jubilee party candidate said.
