A night Guard broke into tears at a Thika Law Court on Wednesday after he was sentenced to serve 18 months imprisonment for sleeping while on duty therefore, failing to prevent a crime.
Justice G. Onsarigo was told that on the night of May 29 in Ruiru Township, Kiambu County while on duty at Macharia building, Eric Mwema an employee of Straight Security Company failed to prevent an offence of shop breaking.
The accused attempts to explain to the magistrate that he fell asleep on the material date because he was a collage student during the day and a night guard during the night fell on deaf ears and was to serve the sentence with no option of a fine.
Prosecutor Dan Odhiambo told the Court that on the material day, the accused person was on duty when thugs broke into the shop of the complainant (Mutende Kasyoka) who operate an MPESA shop on the same building where the accused was assigned to Guard.
The court heard that the complainant locked her MPESA shop which also doubles up as a Cyber Cafe and retired to her home only to find out the following day that her shop had been broken into and several items which included four computers, one laptop, seven phone chargers, one mobile phone and Sh150,000 had been stolen.
She reported to the area Police who arrested the night guard immediately and arraigned him before court.
He asked for leniency saying that his efforts of trying to earn an honest living by improving on his education to get a better job will go into waste if he was incarcerated for the 18 months.
