Men suspected to be gay will no longer go through forced anal examination after the Court of Appeal in Mombasa on Thursday ruled that the examination is unlawful.
This comes after Human Rights Watch and right groups urged that the anal testing is a form of torture.
According to the Human Rights watch, the process involves medical practitioner inserting their fingers and sometimes other objects into the anus of the accused.
In other occasions, the suspected men are ordered to strip naked to and lie down with their feet in stirrup or bend over as medical personnel visually examine their anus.
Kenya’s National Gay and Lesbian Human Rights Commission said after the ruling that the inhuman and humiliating examination always torment the suspects for their entire lives.
Speaking after the ruling, the acting director of Kenya’s National Gay and Lesbian Human Rights Commission, Njeri Gateru said that it is time that the dignity of Lesbians and gays is preserved at it should be and as stated in the constitution.
“We just honestly think that it’s about time that the dignity of LGBT people is preserved as it should be, as enshrined in the constitution,” said Njeri as quoted by voanews.
The commission also hopes that the ruling is going to influence another case to decriminalize homosexuality.
