A driver who allegedly caused the death of a university student as he tried to evade arrest at an alco-blow check-point will be subjected to a full criminal trial.

Job Nyongesa Wangila is accused of causing the death of 21-year-old Brian Kiambati, a first year engineering student at University of Nairobi in an accident that occurred along the Thika Superhighway on January 30, 2016. 

A Nairobi court declined to terminate criminal proceedings against the accused with presiding Magistrate Elector Riany ruling that Wangila will to have to stand a full trial. 

The prosecution said that Mr Wangila drove on the wrong side of the road and rammed into another car being driven by Kiambati and led to his death. 

Through his lawyer John Khaminwa, Wangila had also argued that the charge sheet presented by the prosecution had used his Christian name which is unlawful since the State has no religion. 

Khaminwa said that the details in the charge sheet were interfering with his presumption of innocence. 

However prosecutor Mary Ng’ang’a said the charge sheet met all the constitutional requirements and protests by the defense were merely delaying tactics. 

Nyongesa is out on a Sh100 000 cash bail.
