The High Court on Wednesday upheld the election of Ali Roba as Mandera Governor during last General Election.
Justice Fred Ochieng dismissed the petition filed against Roba citing lack of evidence of electoral malpractice as alleged by the petitioner.
The petition was filed by Mr Hassan Noor who moved to court seeking to nullify Mr Roba’s election over claims that the election was not free and fair.
Justice Ochieng in his ruling said that the errors and malpractices highlighted by the petitioner were not sufficient to warrant nullification.
The judge ruled that the discrepancies found after a scrutiny of the votes could not affect the outcome of the August 8 General Election.
The court also ruled that the petitioner did not provide any evidence that his agents were locked out of polling stations which they were assigned.
He further stated that the results declared by the Returning Officer reflected the will of the people of Mandera County.
Following the loss, Justice Ochieng ordered the petitioner to pay costs amounting to not more than Sh5 million to Mr Roba and the Independent Electoral and Boundaries Commission (IEBC).
