Residents of Nyabiosi in Nyamira County are in the final process of suing the Kenya National Highway Roads Authority following a demolition order that was served to them last week.

Speaking to Hivisasa.com on Wednesday, Ken Ombui, a victim of the demolitions that are expected to pave way for the ongoing construction of Metamaywa-Kebirigo road, said they were disgusted with the order since their houses were in ‘safe’ positions from the road.

According to him, the demolition order should be halted by the court till their concerns are heard by the authority since most of them may lose millions through the demolition of the houses.

“We want to make the state knows that the rights of citizens are supreme to anything. No one should order us to demolish what we took years to build and furthermore that is away from the road,” he said.

“We demand that we are given a fair hearing by the state because we may lose millions of shillings without compensation. They have to reevaluate the land and confirm whether it belongs to the government or us,” he said.

The suing preparations were confirmed by high court advocate Evans Minda who said the application will be made public in the Kisii law courts before the end of the week.

“I have assessed the case and we have compiled a serious application to that effect. They have a genuine concern and the state through the highway authority must respond to it. If you look at the buildings, they are clearly off the road,” Mr Minda said.
