Nyamira Governor John Nyagarama has maintained that he won the last General election in a free and fair manner. 

In a sworn affidavit before Justice James Makau on Thursday, Nyagarama told the Nyamira High Court to dismiss an election filed by Walter Nyambati seeking to nullify his win, terming it as defective and baseless. 

The county boss insisted that his win reflects the will of the people of Kisii, adding that he has no case to answer. 

He also said that he will still beat his rivals hands down if even the court ordered a by-election in his county.

"The will of the people will be determined by counting the votes in the ballot boxes in the disputed polling stations. I am confident that I will still emerge the winner," he said, as quoted by The Star.

Through his lawyers Erastus Orina, Stephen Ligunya and Nyagaka Nyachiro, Nyangarama requested the court to drop the petition against him in order to give him humble time to deliver on the promises he made to his people while seeking the post. 

He also dismissed bribery claims, saying he has never had intentions of subverting the will of the common mwananchi because of his selfish interests.

The complainant (Nyambati) had accused Nyagarama of colluding with the Independent Electoral and Boundaries Commission (IEBC) of colluding to deny the people their victory. Nyambati told the court that the exercise was marred by all sorts of illegalities and irregularities that influenced the outcome.

Through his lawyers Kennedy Nyaencha, Nyambati had asked the court to overturn the election results. Lawyers Jackson Nyamweya and James Mamboleo are representing IEBC and returning officer David Towett. The case will resume on January 23, 2018.
