Lawyers representing 43 suspects among them Public Service Principal Secretary (PS) Lilian Omollo and NYS Director General Richard Omollo charged with corruption-related offenses in relation to the Sh9 Billion loss at NYS have vowed to appeal court ruling that denied them bail.

The lawyers led by Cliff Ombetsa say that they will be moving to High Court to appeal the ruling.

Ombetsa argues that the Magistrate court ruling that denied the NYS suspects bail or bond was unconstitutional.

According to the lawyer, all crimes are bailable and so the court had no justification to deny the suspects bond.

“We are aggrieved by the ruling and we will be challenging it in court on Wednesday,” Ombetsa told journalists at Milimani Law courts on Tuesday.

The lawyer said that their clients are innocent until proven guilty, accusing the prosecution of condemning them.

On Tuesday, Anti-Corruption Magistrate Douglas Ogoti denied all the 43 NYS suspects bond or bail.

The Magistrate ruled that the crimes committed by the suspects are serious and threaten the country’s security.

“These crimes are serious as argued by the prosecution and could lead to anarchy,” the Magistrate ruled.

The 43 suspects among them PS Omollo will be remanded at the Langata women’s and Industrial Area prison until their trial is heard and concluded.

The court ordered the prosecution to supply suspects lawyers with witness’s statements and speed up the case.
