The Kenya National Union of Teachers (KNUT) national chairman Mudzo Nzili has reiterated that teachers will not report to work in September if the government fails to implement their salary increment.
Speaking in Kiambu on Friday during the union's branch AGM, the KNUT chairman said that if the Supreme Court quashes the ruling by the lower courts they will have no option but to down their tools.
"We will not accept anything contrary to what the court previously ruled. This issue of taking teachers from one court to another as if they have no rights is unacceptable. Teachers are tired and won't resume duty on September if they don't get justice,” he said.
He says the Teachers Service Commission (TSC) has ignored its responsibility of ensuring that teachers are paid well.
The Supreme Court is expected to deliver a ruling on Monday as whether to uphold the High Court and the Court of Appeal rulings or quash them.
KNUT and the Kenya Union of Post Primary Education Teachers (Kuppet) are represented by lawyers Paul Muite, Kioko Kilukumi, John Mbaluto and Judith Guserwa while Fred Ngatia, Issa Mansur and Allan Sitima represent TSC.
TSC argues that there is no money allocated for the salary increase.
"TSC does not generate funds. The money that is paid as salaries emanates from the Treasury and there is none for it now. We have a live problem which is Sh73 billion for pay before the appeal is heard. Every aspect of the republic has to be stopped for the teachers to be paid," Fred Ngatia's submission at the Supreme Court is quoted in The Standard.
