ODM leader Raila Odinga’s plot to boycott elections could force IEBC to reschedule October elections to a later date, observes lawyer Moseti Moseti.
Amid uncertainty, Odinga is set to fly to UK to deliver a public lecture later on Monday but its unclear when he would return for elections.
But Moseti says should Odinga boycott, then IEBC could be compelled to cancel the elections to avoid a constitutional crisis ahead on November 1st constitutional dateline.
“If he boycotts elections, the Supreme Court ruling gives a direction on that. The IEBC chairman can cancel elections and order fresh presidential nominations.
“The process would mean that we shall have elections in yet another three months and that is the only way we can avoid a constitutional crisis,” he says.
According to him, article 138(2) of the constitution ties IEBC from conducting elections without participation of disgruntled party, since many regions may not have returns.
A defiant Odinga now wants IEBC to send packing a number of officials along with revoking printing contract given to a Dubai based company, Al Ghurair.
