Despite electoral body IEBC’s independency, opposition leader Raila Odinga will use the Supreme Court ruling and subsequent criminal prosecution of its officers to derail elections.

Already, IEBC has set October 26th for presidential election repeat, a dare that Odinga has dismissed as ‘suggestion of OT – Morpho and Uhuru Kenyatta’, further putting the country of a verge of possible constitutional crisis.

In his analysis, lawyer Nelson Havi says Odinga will get a backing of international community, a move that could still compel the commission to carry out internal changes.

“Time is not on our side and the commission is yet to do any changes. The court found the commission culpable of illegalities which were definitely executed by individuals.

“Should they fail to agree an overhaul, the said date will still not make sense because the whole world knows something went wrong and they will back Odinga’s quest for credible polls,” he says.

Already, NAS is set to initiate criminal prosecution on a section of secretariat members with CEO Ezra Chiloba being the prime target.

With court cases in place, Havi says, the opposition will still push its agenda to have a number of officials shown exit door, a move that could further lead to a constitutional crisis.

In the event of a crisis, the country could plunge into a serious crisis in which a caretaker government is likely to take over from President Uhuru Kenyatta.
