Though it is the party that clinched the most number of MP seats among the NASA affiliates in Nairobi, ODM celebrations have been cut short after ANC's Elizabeth Ongoro went to court to contest the win by TJ Kajwang.
In the August 8 general election, ODM's Kajwang garnered 32,190 votes against ANC's Ongoro who garnered 28,127 votes.
But on Tuesday Ongoro filed the at the Milimani law Courts saying the MP vote was marred by massive irregularities.
"With impunity, Kajwang contravened the rule of law and the principles of conduct of a free and fair election through the use of intimidation, coercion and improper influence of voters," she said.
Ongoro has asked the court to nullify the vote as it was affected by non-compliance, irregularities and improprieties.
She also wants IEBC to be directed to organise and conduct a fresh parliamentary poll in strict conformity with the Elections Act.
