The Orange Democratic Party (ODM) has moved back to the Court of seeking to block the Thursday repeat presidential polls.
Through lawyer Nelson Havi, ODM sought to overturn a high court decision that allowed Thirdway Alliance presidential candidate Ekuru Aukot and six others to participate in the fresh elections.
It is not clear why NASA wants Aukot barred from the ballot considering that the party supported Aukot’s petition before justice John Mativo.
In the appeal, ODM stated that the judge made an error in law by allowing Aukot to participate in the elections.
ODM also says the judge erred in law by departing from the decision of the Supreme Court defining a fresh election under Article 140.
