A polling officer accused of doctoring an affidavit that caused a legal battle between election candidates has been permitted to contest the charge at the High Court.
Peter Oyuko was granted the permission by resident Magistrate Martha Agutu who agreed to delay charges against him Oyuko's lawyers claimed that the court lacked such jurisdiction.
The primary school headmaster who served as a presiding officer during the filed his petition at the High Court yesterday.
He is said to have sworn fake affidavits that indicated he submitted results which showed former MP Ayiecho Olweny had beat Onyango K'Oyoo.
Oyuko was freed on a Sh300,000 bond.
