Nominated MCA Damaris Mouni has vowed to appeal the decision by Nyamira High Court to dismiss her nomination to the assembly as 'irregular' in the Wednesday's decision.
Justice James Makau ordered Nyamira Assembly clerk to swear in Irene Nyakerario in her place 'immediately'.
And Mouni, mother to condemned Ex-PA to IEBC Chair Wafula Chebukati, Mr Gekara Mouni, has termed the decision 'draconian' and vowed to challenge it.
"I was regularly nominated and I proved beyond reasonable doubt. I respect the court ruling but the fight continues.
"It is unfair that the party wants to impose someone who does not even know our boundaries. I will appeal the ruling," she said.
Reportedly, Mouni was irregularly entered into ODM nomination list at the expense of Nyakerario by her embattled son.
After the ruling, an excited Nyakerario vowed to work diligently by serving interests of the party in the assembly.
