A petition challenging the election of Nyamira Governor John Nyagarama received a major boost on Monday following the High Court’s order for recount and scrutiny.
Petitioner Walter Nyambati, who contested on Jubilee ticket, had applied for recount in 126 polling stations of 553, a move that was opposed by IEBC and Nyagarama’s legal team.
“Recount and scrutiny will not prejudice rights of any party and I therefore order recount in 90 polling stations. The second respondent will organize the venue for the same,” ruled Justice David Majanja.
The ruling is a major reprieve to President Uhuru Kenyatta, who moments before repeat polls, said he was monitoring the situation in Nyamira.
During the August poll, Uhuru managed 52 percent of votes cast in a region that has traditionally supported the ODM party.
“I am aware of a petition on governorship and I believe justice will be delivered in court,” Uhuru told a section of Gusii leaders at Nakuru State Lounge.
Already, Jubilee party has lost two seats with Webuye West MP Dan Wanyama and Kitui South’s Rachael Nyamai having their victory nullified in a series of setbacks on Uhuru’s party.
