Ex-Kitutu Masaba MP Timothy Bosire would after all appeal a court decision that declared his petition against the incumbent 'null and incurable'.
High Court Judge James Makau, while upholding Shadrack Mose's victory on Thursday, also ordered the petitioner to pay Sh 5 million to IEBC and the MP.
"We will go further steps to seek justice. For now, we respect everything and the position as it is," said the ODM Treasurer.
He added: "As paceful people, we respect law and order and in the end, we shall respect the final judgment that will be given in any stage (Appeals Court)."
The trained economist is a chief critic of Jubilee administration and at some point, he defied President Uhuru Kenyatta's order to stand in parliament.
During the August polls, Bosire lost to Mose, a city advocate on Jubilee ticket by nearly 13,000 votes.
