ODM National Treasurer Timothy Bosire will know his fate on a petition challenging election of Kitutu Masaba MP Shadrack Mose in February.

Bosire, a close ally of opposition leader Raila Odinga, lost marginally to Mose, in an election that attracted campaigns by both President Uhuru Kenyatta and Odinga.

Through a voter, Justus Omiti, Bosire challenged the August outcome citing illegalities and irregularities.

And after month of court battle, Judge James Makau on Friday said that he will make a ruling in February.

All respondents were given 10 days to file final written submissions after which the judge will retire to write a judgment.

The former Kitutu Masaba MP was among chief campaigners of Raila Odinga across the country and his points man from the larger Gusii region.

It is not the first time Bosire is challenging an election given that he won a similar case against Walter Nyambati in 2011 after three years of court battle.
