Justice Roselyne Aburili ruled that the implementation of rules that candidates and political parties should establish campaign committees and open accounts for campaign funds had not been enacted by Parliament.

She added that the IEBC was acting unlawfully since Parliament was yet to enforce provisions of Section 6 of the Elections Campaign Act 2013.

The Judge further ruled that IEBC's requirement that aspirants should have disclosed their campaign finance accounts by December 8, 2016 was vague. She said public servants were yet to resign and declare their interest in various political posts.

She asked the Commission to comply with Court ruling, similar to ODM's recommendations.

ODM failed the application through senior counsel Siaya senator James Orengo.
