Justice George Odunga has declined to withdraw from hearing an application by Machakos governor aspirant Wavinya Ndeti.
This is after IEBC requested to have another judge hear the case.
Lawyer Paul Nyamodi said Odunga had already determined a similar dispute on Ndeti’s membership.
Odunga ruled that she was a member of CCU party and the same court cannot give a different opinion.
Odunga said on Wednesday that the IEBC's application for his disqualification did not demonstrate bias on his part.
"Judges are trained to serve all parties without favour or discrimination," he also noted.
He dismissed the application and ordered the commission to compensate Ndeti.
On June 9, the politician got a temporary reprieve after the High Court directed the IEBC to include her name their Gazette notice.
